Tagging someone else in a photo
If we were to judge by the number of lawsuits that can be thrown upon you, it appears that social media is the root of all evil these days. Apart from the fact that getting tagged in a picture can get you sued, tagging someone else in a photo can also open you up for a lawsuit, warns Kevin Adkins, attorney with the Kenmore Law Group. “Many people may post a slew of photos to their Facebook or Instagram pages and tag everyone in them but if you don’t have their permission you can get hit with a lawsuit,” he explains.
“The right of publicity” belongs to every citizen, so if you post a photo without someone’s permission or share a picture which could affect the other person’s image (like tagging someone in a picture where he/she appears to be drunk), they might sue you. They probably won’t, being your friend and all, but why risk it?
What you can do instead: Before tagging someone on Facebook or Instagram always ask for permission. An even better option would be to ask everyone to tag themselves if they want to.
