“Social media is the new ‘paper trail’ and the worst part is most people don’t even realize they are making one,” warns Nicole Sodoma, family law attorney and Managing Principal, Sodoma Law. Even the most ordinary things like going on a romantic weekend with your new significant other can provide plenty of information as to your location, your financial status or current relationship status and can be used against you.

“For example, posting a cute picture with your girlfriend to Facebook before your divorce has been finalized can result in an ‘alienation of affection’ lawsuit, impact an alimony claim, hurt settlement negotiations, and much more,” she says. You don’t even have to post the photo yourself, just being tagged in it is enough.

What you can do instead: It’s tough in this age of oversharing but ideally take a social media break for anything personal, she says. And, don’t forget that text messages and emails are considered evidence too.
